Terms of Services

Welcome to LitCommerce. These Terms of Service (“Terms”) will govern your access to and use of our service, software, application, plug-in, component, functionality, or program created by LitCommerce (collectively, “Services”). Please read the following terms and conditions carefully before using the LitCommerce website or any of our Services. By using LitCommerce Services, you (“you” or “User”) signify that you have read, understand, and agree to be legally bound by these Terms. Violation of any of the terms below will result in the termination of your account relating to LitCommerce.

The terms “we”, “us” or “our” shall refer to LitCommerce. The terms “you”, “your”, “user” or “customer” shall refer to any individual or entity who accepts these Terms, or purchases our Services.

By using LitCommerce Site or our Services, you represent and warrant that you are: (i) at least eighteen (18) years old of age, (ii) otherwise recognized as having fully ability to form legally binding contracts under applicable law, or (iii) are not a person barred from purchasing or receiving the Services found under the laws of the United States or other applicable jurisdiction.

If you are entering into these Terms on behalf of a corporate entity, you must verify that you have the authority necessary to bind the entity to the Terms. In these cases, “you”, “your”, “user” or “customer” as used in these Terms shall refer to such corporate entity.

1. Modification of Terms, Site, or Services

1.1. LitCommerce reserves the right to modify these Terms at any time. However, we will post any changes on this page and, if they are significant, we will include a prominent notice. Your continued use of the Services following such modifications shall constitute your consent to the modified Terms. If you don’t agree to be bound by these Terms at last revised, then you may not use (or continue to use) the Services. Therefore, you should regularly check for the most recent version.

1.2. It is highlighted that LitCommerce retains the right to modify, change, or discontinue any aspect of the LitCommerce Site or Services, at any time. We also reserve the right to create limits on use, suspend or terminate users at our sole discretion at any time.

2. Your Registration Obligations

2.1. To access and use our Services, you must create an account on our Site or sign in using your Google/Facebook account. By registering, you represent and warrant that the information you provide is accurate, current, and complete, and you undertake to maintain its accuracy.

2.2. If we find out that your provided information is inaccurate, not current, or incomplete, your account will be suspended or terminated.

2.3. You are responsible for maintaining the security of your account and the accompanying password. You are solely responsible for all activities that occur on your account. LitCommerce will not be liable for any loss or breach of confidentiality from your failure to comply with this security obligation.

3. Availability of Website/Services

3.1. We will make reasonable efforts to ensure our services are available to you on a 24/7 basis, which means you can access our Services at any time. However, you must acknowledge and accept that there may be times when our Site/Services are inaccessible or inoperable for some following reasons: equipment malfunctions, periodic maintenance, repairs or replacement; or caused beyond our reasonable control or that are not reasonably foreseeable including, but not limited to, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network congestion or other failures.

3.2. You will not be charged until the Free Trial has concluded. If you don’t want to continue using our Services, visit your Account and click the cancel link. Or else, you can choose a paid plan and enter billing information before your Free Trial ends; the Services will automatically renew at its then-current renewal price without any further actions from you.

3.3. The Free Service will not provide you with unlimited access to all features of our Services. If you don’t cancel the Free Service, it will automatically be renewed monthly. If you want to cancel or upgrade your Free Service, visit your Account and select the cancel link. If you choose to cancel Free Service, any content or data you have entered into the service will only be retained for 60 days from the date of cancellation for customers with billing addresses in non-GDPR countries or 30 days from the date of cancellation for customers with billing addresses in GDPR countries. The Free Service is only available for customers from certain areas.

3.4. LitCommerce has the sole right to modify or end the Free Trial and Free Service, or offer another similar service, at any time. You will be charged the then-current rates for the Service if we determine that you are not eligible for the Free Service.

4. Discontinued Services; End of Life Policy

4.1. Although LitCommerce is continually striving to maximize the lifespan of our Services, we may discontinue one of our Services when it reaches its End-of-Life (EOL). In these cases, LitCommerce will no longer offer any support to that service, effective on the EOL date.

4.2. For any Service being planned for EOL, we will issue an EOL announcement one (1) calendar month or earlier prior to the EOL date. It is your responsibility to take all necessary steps to replace the Service by migrating to a new Service before the EOL date, or by entirely ceasing reliance on said Service before the EOL date. In either case, LitCommerce will either offer a comparable Service for you to migrate to for the remainder of the term of your purchase, a prorated in-store credit, or a prorated refund, to be determined by LitCommerce in its sole and absolute discretion.

4.3. LitCommerce may, with or without notice to you, migrate you to the most up-to-date version of the Service, if available. You agree to take full responsibility for any and all loss or damage arising from any such migration.

5. Fees and Payment; Automatic Renewal

5.1. Your charges and fees are set forth on your order documentation. You can choose from 2 pricing plans: monthly and annual. If the payment process fails, your account will be suspended or inaccessible until all payments have been successfully processed.

5.2. Price Changes: LitCommerce retains the right to change its prices and fees at any time without notice to customers. These price modifications will be posted online at this Site. If you are a monthly or yearly subscriber, changes in prices and fees will be applied to your next renewal term.

5.3. To ensure your continued use of our Services with no need to keep track of renewal dates, LitCommerce offers our services on an auto-renewing subscription basis. Unless you cancel your use of our Services prior to the eligibility end date, LitCommerce will automatically renew your subscription monthly or yearly, depending on your current pricing plan. Your payment method will be charged the subscription charge on the first day of the renewal term.

6. Refund Policy

6.1. This section governs the terms under which refunds may be issued for LitCommerce. Your use of the Services signifies your agreement to this Refund Policy. Failure to comply with this Policy will result in the termination of your access to the Services.

6.2. LitCommerce services are prepaid. Apart from the money-back guarantee described below, charges are non-refundable. This means cancellations do not result in refunds for monthly or annual subscriptions.

6.3. Refund Eligibility

6.3.1. We offer a 30-day money-back guarantee on the first purchase. This means you have 30 days from the purchase date to request a full refund for any reason. This guarantee applies to all LitCommerce products and services and only applies once.

6.3.2. No refunds are available after the 30-day period. Once 30 days have passed from the purchase date, charges are 100% non-refundable, except in the limited circumstances described below.

6.3.3. After the initial 30 days, refunds are only considered for significant issues resulting in data loss or severe disruption of your LitCommerce account. We will not process refunds for the following reasons:

  • Accidental purchases (e.g., purchasing in error, or purchasing another app or plan by mistake)
  • Unintentional continued subscription (e.g., forgetting to cancel before an auto-renewal)
  • Past-due refunds
  • Expertise insufficiency
  • Goodwill requests
  • Change of mind about app usage

No refunds for discounted purchases: If you have accepted or redeemed a discount, promotional offer, or special pricing on your purchase, that purchase is not eligible for a refund. Choosing a discount offer waives the money-back guarantee for the discounted purchase.

6.3.5. We are not liable for, and will not issue refunds for losses, damages, or injuries (personal or property) arising from:

  • Misuse of our service
  • Failure to follow our instructions
  • Your use of third-party products or services
  • Your decisions and actions

6.4. What Will Happen To My Account?

6.4.1. Requesting a refund will cease your access to LitCommerce paid plans. All associated features will be deactivated.

6.5. Refund Payment Method

6.5.1. We issue refunds via your original payment method (PayPal or associated instrument). To initiate a refund request, please contact our Support Team.

6.5.2. If you purchase LitCommerce through App Markets, the payment processing time may take up to 7 business days. Your refund will be issued as soon as the payment is received.

6.5.3. Refunds are typically processed within 3-5 business days. Please notify us of any unexpected delays.

7. Service Termination

7.1. LitCommerce may terminate your access to the Services without notice if you:

  • Violate these Terms and Conditions
  • Fail to pay any outstanding payments
  • Engage in harmful conduct toward LitCommerce and other users, or create liability for either party, as determined solely by LitCommerce

7.2. Upon termination, no refunds will be issued for prepaid fees. You are responsible for all fees accrued before termination, plus any remaining costs for the current billing cycle.

8. Limitation of Liability and Disclaimer of Representation and Warranties

8.1. The Services are available “AS-IS”. Your access to and use of the Services are at your own risk. You understand and agree that the Services are provided to you on an “AS IS” and “AS AVAILABLE” basis. LitCommerce make no warranty or representation and disclaims all responsibility and liability for the accuracy, completeness, availability, timeliness, security or reliability of the Services or any Content of this site; the accuracy, completeness or content of any sites linked (through hyperlinks…); whether the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.

8.2. In no circumstance and in no event shall LitCommerce be liable to you for any direct, indirect, incidental, special, punitive or consequential damages or loss profits.

8.3. No advice or information, whether oral or written, obtained from the LitCommerce Entities or through the Services, will create any warranty or representation not expressly made herein.

9. Update Notice
